2. Definition “Personal Data”

“Personal data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

3. Processing of personal data

By visiting the BKL-website, we only collect the data transmitted by your browser to our server. This is necessary to display the BKL-website correctly and to ensure stability and security. This includes: IP-address, date and time of the request, content of the request (actual page), access status / HTTP status code, amount of data transferred, website from which the requirement comes, browser, operating system and its interface, language as well as the version of the browser software.

It is not possible to draw any conclusion about the respective person based on this data. The processing of this data is based on Art. 6 par. 1 sentence 1 lit. f GDPR. For technical safety reasons these data are used to prevent attacks on our web server. The data will be anonymized by shortening the IP-address after seven days at the latest. There is no evaluation of this data except for statistical purposes in anonymous form. Also, there is no merge of this data with data from other sources.

Voluntary provision of data
Registrations:
After providing your data, as for example in context of registrations, filling out forms or inquiries, the elicitation of data will follow. We process, use and disclose your data only in the necessary processing of your request. Legal basis for our use of your data is our legitimate interest in answering your matter in accordance with Art. 6 par. 1 sentence 1 lit. f GDPR as well as Art. 6 par. 1 sentence 1 lit. b GDPR in case of contract conclusions.
Applications:
In case you send us personal data in the form of job application documents in electronic format or if you complete our application form for online applications, we will process and use such information solely for the purpose of carrying out the application process and possible origination of an employment relationship with BKL. After expiration of the legal period, we will automatically delete your application documents in the system, unless you explicitly agree to a longer storage period in writing. Disclosure of your job application documents to third parties will be made only if you explicitly authorize us to do so in writing.
Newsletter:
If you have subscribed to our newsletter, your personal data will be used advertising purposes as well as for dispatch of the newsletter but will not be made available to any third parties. The newsletter contains details of campaigns, events, news, products or other information. We save your IP-address for your registration. This storage takes place for reasons of proof and to prevent misuse.
You can unsubscribe from the newsletter at any time with effect for the future by using the unsubscribe link (which is included in every newsletter), by sending us an e-mail to newsletter@bkl.de, or by sending us your unsubscribe by post. After your successful unsubscribing, your e-mail-address will immediately be erased from our newsletter distributor, except you have explicitly agreed to a continued use of your data or if the continued use is extend permitted by law.
Deletion:
Your data will be deleted if retention is no longer required for the purposes described in this data protection and is no longer required by law.

4. Google Analytics

The BKL website uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses 'cookies', which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. In case of activation of the IP anonymization, Google will truncate/anonymize the last octet of the IP address for Member States of the European Union as well as for other parties to the Agreement on the European Economic Area.

Only in exceptional cases is the full IP address sent to and truncated by Google servers in the USA. On behalf of the website provider, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage to the website provider. We use "Google Fonts" on our website, a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter referred to as: "Google"). Google Fonts enables us to use external fonts. For this purpose, the required Google Fonts are loaded into your browser cache by your web browser when you access our website. This is necessary so that your browser can display a visually improved representation of our texts. If your browser does not support this function, a standard font will be used by your computer for display.
The fonts are hosted by us and therefore are not loaded by an external provider. This requires the processing of your IP address.
We use Google Fonts for optimization purposes, in particular to improve the use of our website for you and to make its design more user-friendly. The legal basis for the data processing is our legitimate interest (Art. 6 para. 1 lit. f GDPR).

1. Allgemeines

Wie bei unseren Leistungen rund um den Kran, haben wir bei der Erstellung der Mein BKL App ein Höchstmaß an Sorgfalt zugrunde gelegt. Nichtsdestotrotz bitten wir Sie, die folgenden Hinweise aufmerksam durchzulesen und bei Fragen Kontakt mit uns aufzunehmen (Verantwortlicher gem. Art. 4 Abs. 7 DS-GVO):

Die Mein BKL App verarbeitet, bis auf eine kurze IP-Zwischenspeicherung, die technisch notwendig ist, keine personenbezogenen Daten. Personenbezogene Daten werden nur dann erhoben und verarbeitet, wenn Sie diese von sich aus zur Verfügung stellen, beispielsweise im Rahmen von Anfragen, oder dem Ausfüllen von Formularen. Die Erhebung, Verarbeitung, Nutzung und Weitergabe Ihrer Daten erfolgt lediglich, soweit dies zur Bearbeitung Ihrer Anfrage notwendig ist bzw. Sie dem zugestimmt haben.

Nach der Erstinstallation der Mein BKL App werden Sie, abhängig vom Betriebssystem, nach gewissen Berechtigungen gefragt (z.B. Zugriff Standortdaten, Push-Nachrichten zulassen) Diese Berechtigungen sind für eine optimale Funktionsweise der App notwendig. Diese Einstellungen können Sie natürlich jederzeit in den Einstellungen der App verändern.

2. Google Firebase

Damit die Qualität unserer APP sich stetig verbessert verwenden wir Google Firebase, einen Dienst, mit dem App-Nutzungsdaten vom Smartphones erfasst und analysiert werden können. Google Firebase ist eine Echtzeit-Datenbank, mit der sich Echtzeitinformationen in die eigene App integrieren lassen.
Dazu werden bestimmte Aktionen während der App-Nutzung verschlüsselt und pseudonymisiert (eine Feststellung der Identität des Betroffenen ist damit auszuschließen) an Google Firebase übertragen, damit eine Analyse hinsichtlich des allgemeinen Nutzerverhalten, der Effizienz und ähnlicher Betrachtungsweisen stattfinden kann und im Zuge der Auswertung Rückschlüsse auf die stetige Verbesserung der App gezogen werden können. Sie können die Erfassung sowie die Verarbeitung dieser Daten dadurch verhindern, indem Sie bei den Einstellungen die Nutzungsberichte deaktivieren.

3. Standortdaten

Für eine vollumfängliche Nutzung der Mein BKL App, ist die Standortabfrage Ihres Gerätes von Nöten. Bei der Anfrage wird der aktuelle Standort Ihres Gerätes über GPS erhoben, damit wir Ihnen schnell Auskünfte zu Ihrer Umgebung geben können. Ihre Standortdaten werden lediglich zur Bearbeitung Ihrer Anfrage verwendet. Ihre Übertragung erfolgt über eine verschlüsselte Verbindung; nach Beendigung Ihrer Anfrage werden Ihre Standortdaten anonymisiert und zur Verbesserung unseres Services statistisch ausgewertet. Die BKL kann damit keine Rückschlüsse auf Ihre Person ziehen.

4. Benachrichtigungen

Die Mein BKL App informiert Sie über interessante Neuigkeiten mittels Benachrichtigungen auf Ihrem Endgerät, sofern diese Funktion aktiviert wurde. Benachrichtigungen können natürlich jeder Zeit in den Einstellungen der App aktiviert und deaktiviert werden.

5. Datenverarbeitung

Die Verarbeitung Ihrer Daten erfolgt auf Grundlage des Art. 6 Abs. 1 S. 1 lit. f DS-GVO auf Basis des berechtigten Interesses welches im Rahmen der Interessenabwägung erfolgt.
